Terms, privacy and cookies
Three things on one page: the standard terms under which we host mining hardware, what happens to the personal data you send us, and why this website sets no cookies. Plain language on purpose. A signed hosting agreement always takes precedence over this page.
Hosting terms
1. Who we are
Acuario Hosting LLC is a limited liability company registered in Wyoming, United States. It operates mining hosting in Paraguay under its own hosting agreement and on its own infrastructure. You can reach us at info@acuariohosting.com or on WhatsApp at +595 991 929 269.
2. What we do
We host ASIC mining machines that belong to you: we source the hardware on your behalf, import it into Paraguay, install it, supply electricity and cooling, monitor it and maintain the site. You own the machines. We run them.
3. Buying hardware through us
- Hardware prices follow the Chinese market and can change daily. We verify the real price before every purchase and state it in a written offer, together with the date to which it applies.
- The quoted machine price includes shipping, customs clearance and the legal import documents (despacho, factura legal issued in Paraguay), transport to the site, racking, installation and configuration, pool set-up handed over to you, transport to service for the first year, the manufacturer's warranty, and the cleaning and care of the machine. It does not include the deposit.
- The hardware is purchased for you and belongs to you.
4. Deposit
One deposit is due per machine before installation: $350 for an air-cooled machine and $500 for a hydro machine. The deposit is not a fee. At the end of the contract it is consumed as electricity on your final invoices; it is not returned in cash. You do not lose it.
5. Electricity and billing
- Electricity is charged per kilowatt-hour on our published scale, which depends on how many machines you host: $0.080 per kWh 1–5 machines · $0.078 per kWh from 5 · $0.076 per kWh from 10 · $0.074 per kWh from 20 · $0.072 per kWh from 50.
- One month of electricity is paid in advance.
- Paying six months in advance earns a rebate, agreed in writing in your offer.
- We accept payment in USDT and USDC.
- How unpaid invoices are handled is set out in your hosting agreement.
6. Orders, payment and cancellation
- An order is placed when you accept a written offer and pay the hardware price it states. We then buy the hardware for you.
- Once we have placed the order with the manufacturer or supplier it cannot be withdrawn without cost. What a cancellation costs at each stage is stated in your offer; we pass on what the supplier charges us and nothing more.
- Prices are in US dollars and include the import duties and taxes payable in Paraguay to bring the machine into the country. Taxes on your income, and any tax in your own country, are yours.
- Payment is made in USDT or USDC to the wallet named in your offer or invoice, and we confirm receipt in writing. Funds sent to a different address or on a different network than the one we named cannot be recovered by us.
7. Term and end of contract
The hosting contract runs for a minimum of twelve months and can be renewed by agreement. If it is not renewed, we hand the machines over to you or ship them where you instruct, at your cost, once all invoices are settled and the deposit has been applied.
8. Uptime
We guarantee 97% uptime, measured as set out in your hosting agreement. Maintenance that we can plan is announced in advance. We monitor every machine through Foreman and keep 24/7 security and camera coverage on site.
9. Profitability
Mining revenue depends on network difficulty, coin prices, the pool you use and factors nobody controls. We make no promise of profit, and neither side is liable to the other for a change in coin price, network difficulty, protocol or regulation. If mining becomes unprofitable, the contract stands and electricity remains payable for the term. The calculator on this site is an estimate, not financial advice, and we are not investment advisers.
10. Insurance and risk
We do not insure your hardware; insurance is outside our services and is for you to arrange. We take reasonable care of the machines and the site, but we are not liable for loss caused by events beyond our control, including grid failures, natural events or acts of third parties.
11. Warranty and repairs
Machines carry the manufacturer's (Bitmain) warranty. For the first year we handle transport to and from service. Repair costs not covered by the warranty are yours, and we quote them before any work is done.
12. Your responsibilities
- Use the service lawfully and meet your own tax obligations.
- Give us accurate contact details and a correct payout address for your pool, and keep your pool credentials safe once we have handed them over.
- Confirm that the funds you pay with are lawfully yours. We do not do business with persons or entities subject to United States sanctions, and we may decline or end a relationship where the law requires it.
13. Confidentiality
Offers, prices, pool details and anything either side learns about the other's business through the hosting relationship stay confidential, are used only for that relationship, and are disclosed only where the law requires it. This survives the end of the contract.
14. Force majeure
Neither side is responsible for a delay or failure caused by events beyond its reasonable control: failure of the electricity grid or utility, extreme weather, flood, fire, epidemic, government or regulatory action, sanctions, customs delays, delays by manufacturers, suppliers or carriers, or changes to a mining protocol. The affected side tells the other promptly and does what it reasonably can to limit the effect. Obligations are suspended for the duration of the event; electricity already consumed remains payable; what applies beyond that is set out in your hosting agreement.
15. Suspension and termination
- If an invoice remains unpaid after written notice, we may pause your machines until it is settled, and the hosting agreement says when the contract may be ended for non-payment.
- Either side may end the contract by written notice if the other commits a material breach and does not cure it within the period the hosting agreement gives, or where section 12 applies.
- On any termination, sections 7 (handover), 13 (confidentiality), 16 (liability) and 17 (governing law) continue to apply.
16. Liability
To the extent the law allows, our total liability under a hosting relationship is limited to the hosting fees you paid us in the three months before the claim, and we are not liable for lost profits, lost coins or other indirect or consequential loss. Nothing on this page excludes liability that cannot be excluded by law, including for fraud or wilful misconduct.
17. Governing law and disputes
These terms and our hosting agreements are governed by the laws of the State of Wyoming, United States, unless your signed agreement says otherwise. Before either side starts a claim, the founders and you talk in good faith for thirty days to resolve it. Failing that, the state and federal courts sitting in Wyoming have jurisdiction, unless your signed agreement provides for arbitration.
18. General
- Your signed hosting agreement, the written offer you accepted and this page together are the whole agreement between us; where they differ, the signed agreement prevails, then the offer, then this page.
- You may not assign the contract without our written consent. We may assign it to a successor that takes over the hosting business, with notice to you.
- If any provision is found unenforceable, the rest stands. A right not exercised is not waived.
- Notices are given by email to the addresses each side has on record, and count as received on the next business day.
- English is the binding language of this page and of every agreement we sign; translations on this website are for convenience.
19. Changes
We may update this page. The version published here, with its effective date, applies. A signed hosting agreement prevails over this page where the two differ.
Privacy
Who is responsible
Acuario Hosting LLC, Wyoming, United States, is the controller of the personal data described here. Contact: info@acuariohosting.com.
What we collect
Only what you send us. This website has no accounts and no forms that store data on our servers: the enquiry buttons open your own email or WhatsApp with a message addressed to us. When you write, we receive your name, email address or phone number, your company if you mention it, your message, and the machines, quantities and calculator figures you chose to include.
Why we use it
- To answer you, prepare an offer and, if you go ahead, sign and perform the hosting agreement.
- To invoice, support and communicate with you as a client.
- To keep the records the law requires us to keep.
The legal bases are the steps you ask us to take before a contract and the contract itself, our legitimate interest in answering enquiries, and our legal obligations.
Who else sees it
- Our email provider, to deliver and store correspondence.
- WhatsApp (Meta Platforms) if you contact us there — their own privacy policy applies to that channel.
- Our website hosting provider keeps standard server logs (IP address, browser type, pages requested, timestamps) to deliver the site and defend it against abuse.
- Live coin prices: when the calculator loads, your browser requests current prices from Coinbase, and from CoinGecko if you select Kaspa. Those services see your IP address in the same way as any website you visit. Nothing else about you is sent.
- The video on the founders page plays only after you click it, through youtube-nocookie.com. Until then no connection to Google is made; the preview image is served from our own domain.
No advertising networks, no analytics trackers, no data brokers.
Where it goes
We are a United States company operating in Paraguay, so what you send us is processed in both countries.
How long we keep it
Enquiries: as long as needed to answer them. Client data: for the duration of the relationship and the retention periods the law imposes on business records.
Your rights
You can ask us what we hold about you, have it corrected or deleted, restrict or object to its use, or receive a copy. Residents of the European Union and the United Kingdom have these rights under the GDPR and may also complain to their supervisory authority. Write to info@acuariohosting.com.
Security
Only the two founders have access to the mailbox and phone where enquiries arrive. Correspondence is protected by our providers' standard security. No payment card or bank details are ever collected on this site, and we never ask for wallet keys — only for a payout address.
Automated decisions
We make no automated decisions about you and do no profiling.
Age
Our services are for adults and businesses. We do not knowingly collect data from anyone under 18.
